1.1 This Agreement is entered into between a Dual Camera member (the "Member") and Dual Camera concerning the Member's use of the automatic renewal and authorized payment service provided by Dual Camera (the "Service"). It describes the rights and obligations of Dual Camera and the Member in connection with the use of the Service. A "Member" means a natural person who has completed all procedures required to become a Dual Camera member and uses the membership services provided by Dual Camera in compliance with the applicable rules of use. Acceptance of this Agreement is a prerequisite for the Member's use of the Service. Dual Camera has highlighted, in bold type or by other reasonable means, the provisions concerning exclusions or limitations of liability that require the Member's particular attention. Both parties confirm that such provisions do not constitute clauses that "exclude one party's liability, increase the other party's liability, or deprive the other party of its principal rights" as provided in Article 40 of the Contract Law, and both the user and Dual Camera acknowledge their legality and validity. Unless the Member accepts the terms of this Agreement, the Member is not entitled to use the Service. By choosing to use the Service, the Member agrees to be bound by all terms of this Agreement.
1.2 Dual Camera may modify these Service Terms at any time. If the Service Terms are changed, Dual Camera will publish an announcement on the relevant page, and the changes will take effect ten days after the announcement date. If the Member disagrees with any change to this Agreement, the Member may cancel automatic renewal. Continued use constitutes acceptance of all changes to this Agreement.
1.3 To use the Service, the Member must have the corresponding legal capacity and capacity for civil conduct and must be able to independently bear legal liability. A Member under 18 years of age may use the Service only with the participation and supervision of a parent or other guardian. Use of the Service by such a Member is deemed to have been approved by the parent or other guardian.
2.1 The Service is provided to meet Members' automatic renewal needs and to prevent losses caused by a failure to renew on time due to oversight or other reasons. Once the Member activates the Service, the Member authorizes Dual Camera, shortly before the current membership period expires, to instruct the payment channel to deduct the fee for the next billing period from the balance of the Member's own prepaid account, a third-party payment account linked to the Member's account, bank card, or telecommunications account (collectively, the "Account"). Billing periods include, without limitation, monthly, quarterly, and annual periods, and the Member may choose from the billing periods displayed on the Dual Camera platform. The Service requires the Member's Dual Camera membership account to be linked to one of the above Accounts and a successful deduction from that Account.
2.2 Automatic renewal means that, subject to Section 2.1, Dual Camera charges the membership fee for the next billing period through the Account described above. The Member must ensure that Dual Camera can successfully deduct the fee from the Account. The Member is responsible for any renewal failure caused by insufficient available funds in the Account, and Dual Camera may suspend or terminate the corresponding membership benefits and services.
2.3 By activating automatic renewal, the Member authorizes Dual Camera to issue payment instructions to the Account and agrees that the Account may deduct the fee for the next billing period in accordance with those instructions without verifying the Member's account password, payment password, SMS verification code, or other information. Unless the Member affirmatively cancels automatic renewal, the Member's authorization for automatic deductions by Dual Camera is irrevocable. Except as otherwise required by applicable laws and regulations, fees paid by the Member will not be refunded in any manner.
2.4 When using the Service, the Member is bound by the Dual Camera Privacy Policy, all applicable terms and related supplemental agreements, page descriptions, and standard procedures. By using the Service, the Member accepts these Service Terms and all notices issued by Dual Camera concerning the Service. If this Agreement conflicts with any other Dual Camera agreement, this Agreement prevails.
2.5 The Service provided by Dual Camera is limited to use by the Member on the Dual Camera platform. Any act that separates the Service from the Dual Camera platform through malicious cracking or other illegal means falls outside the scope of the Service under this Agreement. The person engaging in such conduct bears all resulting legal consequences, and Dual Camera will pursue that person's legal liability in accordance with law.
3.1 Dual Camera will provide the Member with a method for checking details of automatic renewal charges, but is not responsible for printing or delivering related invoices to the Member.
3.2 Shortly before the Member's current membership period expires, Dual Camera will send an automatic renewal reminder by SMS or other means. If the fee for the next billing period is deducted from the Account, the charge will be recorded in the Member's payment history on the date of deduction and the membership period will be extended accordingly. Once a deduction succeeds, Dual Camera may collect the fee immediately and will not provide a refund.
3.3 If an error occurs during the deduction process, Dual Camera and the Member will cooperate closely to determine its cause. Each party bears losses caused by its own fault. If losses result from different degrees of fault by both parties, each party bears responsibility in proportion to its degree of fault. If losses result from the joint fault of both parties and their respective fault cannot be distinguished, the parties share responsibility equally.
3.4 Dual Camera may change or amend the service content, rules, and terms of this Agreement based on business development, technical upgrades, or other circumstances. Dual Camera will notify users of such changes or amendments by posting them on a relevant Dual Camera page or in another appropriate location, but has no obligation to provide individual notice. A posted notice is deemed delivered to the user on the date it is issued by Dual Camera. If multiple notification methods are used, delivery occurs at the earliest time any such notice is sent. If the Member disagrees with an amendment, the Member may cancel and stop using the Service. Continued use of services provided by Dual Camera constitutes acceptance of all amendments to this Agreement.
3.5 The Member may choose whether to cancel the Service. If the Member does not cancel it, the Member agrees that Dual Camera may continue to attempt deductions from time to time in accordance with applicable rules. Once a deduction succeeds, Dual Camera will activate membership service for the next billing period.
3.6 If the price of Dual Camera services is adjusted at or before automatic renewal, the then-current price published on the Dual Camera platform applies.
3.7 Dual Camera does not charge the Member any additional handling fee for activating the Service. However, Dual Camera may decide, based on business needs, market changes, or other reasons, whether to charge for the Service itself or adjust the automatic renewal period and fee, and will publish such changes on the relevant page.
3.8 If the Member renews during the current membership period, the new period will be added to the remaining term of the original service period.
3.9 The Member understands and agrees that any deduction authorized by the Member to Dual Camera will be treated as a top-up made by the Member. The Member will not assert any claim or pursue any liability against Dual Camera or its affiliates for any resulting loss suffered by the Member.
4.1 This Agreement takes effect when the Member chooses to accept or use the Service and remains effective until the Member terminates the Service or cancels the membership, unless otherwise announced by Dual Camera.
4.2 The Member may terminate the Service at any time through the membership account settings. After termination, Dual Camera will stop providing the Service to the Member.
4.3 Any automatic renewal instruction entrusted to Dual Camera before the Member chooses to terminate the Service remains valid. Dual Camera will not refund fees already deducted under such an instruction, and the Member bears the related responsibilities and losses.
4.4 Dual Camera may suspend or terminate the Service due to business adjustments, price changes, or other reasons. If this occurs, Dual Camera will notify Members by announcement.
5.1 If either party breaches this Agreement, the non-breaching party is entitled to compensation or damages through the dispute resolution method agreed by both parties.
6.1 Dual Camera and the Member will resolve disputes arising from the performance of this Agreement through friendly consultation. If consultation fails, either party may submit the dispute to the People's Court of Yuhuatai District, Nanjing, for litigation. The laws of the People's Republic of China govern the interpretation, validity, and enforcement of this Agreement.
7.1 If the Member has any questions concerning this Agreement or use of Dual Camera's automatic renewal service, including inquiries or complaints, please contact us through our customer service hotline at 400-093-2666. We will respond as soon as possible after receiving the Member's comments or suggestions.
